1. Introduction

Welcome to Arabian Vistas ("we," "us," "our"). We are a bespoke tour operator specializing in custom travel experiences in the Middle East and North Africa. These Terms & Conditions ("Terms") form a legally binding agreement between you ("the Client," "you") and Arabian Vistas. These Terms govern your use of our website (the "Site"), our travel planning services, and the execution of any trip itinerary. By engaging our services and paying a deposit, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Eligibility

To book a tour with Arabian Vistas, you must be at least 18 years of age and possess the legal authority to enter into a binding contract on behalf of yourself and all persons named in your booking. You affirm that all information provided to us is true, accurate, and complete.

3. Client Responsibilities

You, the Client, agree to provide current, complete, and accurate information for all travelers in your party. This includes, but is not limited to, full names as they appear on passports, dates of birth, dietary requirements, and any physical or medical conditions relevant to the planned activities. It is your sole responsibility to ensure that all travelers possess a valid passport (with at least six months' validity from the date of return), any necessary visas, and comply with all health requirements for the countries to be visited. Arabian Vistas is not responsible for any travel disruption or costs incurred due to failure to meet these requirements.

Furthermore, it is a mandatory condition of booking that you and all members of your party purchase comprehensive travel insurance covering, at a minimum, trip cancellation and interruption, medical expenses, emergency evacuation and repatriation, and baggage loss. Proof of insurance must be provided to Arabian Vistas prior to the issuance of final travel documents.

4. Itinerary Proposals & Booking Confirmation

All itineraries provided to you before a deposit is paid are proposals and are subject to change based on availability. A booking is considered confirmed only when the required deposit has been paid by you and you have received a formal booking confirmation email and invoice from Arabian Vistas. We reserve the right to substitute hotels, riads, desert camps, guides, or other services with an equivalent or higher standard at any time due to circumstances beyond our control. Any such changes will be communicated to you as soon as possible.

5. Fees, Pricing, and Payment

All prices are quoted in US Dollars ($) unless otherwise specified. A non-refundable deposit of 30% of the total trip cost is required to confirm a booking. The final balance is due no later than 90 days prior to the trip departure date. If a booking is made within 90 days of departure, full payment is required at the time of booking. Failure to pay the final balance by the due date will be considered a cancellation by you, and the deposit will be forfeited. Prices are subject to change until a deposit has been paid.

6. Travel Documents and Itinerary Changes

Your final travel portfolio, containing all necessary vouchers, contacts, and your detailed day-by-day itinerary, will be sent to you approximately 3-4 weeks before departure. While we strive to adhere to the confirmed itinerary, Arabian Vistas reserves the right to make modifications for reasons of safety, weather, local conditions, or other unforeseen circumstances. In such cases, we will provide the best possible alternative. We are not liable for any expenses or losses incurred due to changes or delays in your international flights or other travel arrangements not booked by us.

7. Cancellations, Refunds, and Changes Policy

All cancellation requests must be made in writing. The following cancellation fees apply, calculated from the date we receive your written notification:

• 91+ days prior to departure: Forfeiture of the 30% deposit.
• 61-90 days prior to departure: 50% of the total trip cost is non-refundable.
• 0-60 days prior to departure: 100% of the total trip cost is non-refundable.

8. Intellectual Property

The "Arabian Vistas" name, logo, website content, text, photography, and all custom-designed itineraries and service names are the exclusive intellectual property of Arabian Vistas. We grant you a limited, non-transferable license to access our Site and view our materials for personal, non-commercial use. Any unauthorized use, reproduction, or distribution of our brand assets or itinerary content is strictly prohibited.

9. Limitation of Liability

Arabian Vistas acts as an agent for third-party suppliers, such as hotels, activity providers, and transportation companies. We are not liable for any personal injury, property damage, loss, or other damages resulting from any act or omission of these suppliers. Our liability is limited to the total cost of the trip you have purchased from us. We are not responsible for events of Force Majeure, including but not limited to acts of God, war, terrorism, political instability, pandemics, natural disasters, or other circumstances beyond our reasonable control.

10. Applicable Law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai. In the event of any dispute arising from these Terms or our services, the courts of Dubai shall have exclusive jurisdiction.

11. Policy Updates

We reserve the right to update or modify these Terms & Conditions at any time without prior notice. The revised Terms will be posted on our Site, and the "Last Updated" date will be amended. Your continued use of our services after any such changes are posted constitutes your acceptance of the new Terms.
